Welcome to SANED HEALTH (referred to as “mobile app/app/website/online services/SANED HEALTH), services provided by Obeikan Digital Solutions, a Saudi Company based inSaudi Arabia ( the Company). The mobile app is operated by the Company (referred to as "we/our/us/mobile app/website/online service/SANED HEALTH). As a user (referred to as "you/your/ patients/clients") of the website you must read and acknowledge below the following terms and conditions (the “Terms and Conditions”).

By using the online services, you agree to be bound by the Terms and Conditions. Read carefully before using the online service. If you do not agree (or cannot comply with) any of the Terms and Conditions, do not use the online services.

SANED HEALTH makes this app available for the sole purpose of facilitating communications between health services providers and consumers who choose to use the online service. Under NO condition SANED HEALTH is liable for the consultancy advice of the Doctors or consultants. SANED HEALTH Only provides a platform of communication and connects members (Patients or Clients) with registered / Certified Doctors & Consultants.

Members/Users using the SANED HEALTH accept that any advice provided by the Doctors/Consultants are only between them and Members (Patients /Clients) and SANED HEALTH under NO circumstances may be liable for it. Therefore, members agree that under NO condition they can take any legal action against SANED HEALTH or any of the staff for the advice and consultancy of the Doctors/ Consultants.

 YOUR USE OF SANED HEALTH 

Interaction with health services providers using SANED HEALTH is not intended to take the place of appointments with your regular primary care provider. If you do not have an established relationship with a primary care provider, you are encouraged to develop one. Do not disregard medical advice from your regular doctor or other health professional because of information provided by a health services provider via SANED HEALTH.

SANED HEALTH is not licensed to practice medicine and does not render medical care or medical advice.

Neither SANED HEALTH, nor any of its licensors or suppliers, shall be liable for any advice obtained from a health service provider using SANED HEALTH. SANED HEALTH does not recommend or endorse any specific providers, tests, medications, products or procedures. All services or recommendations made by a health service provider are based on their independent professional judgment.

Do not use this app for emergency medical needs, If you experience a medical emergency, call your doctor or visit hospital immediately.

   INFORMATION ABOUT HEALTH SERVICE PROVIDERS 

When you choose to use the SANED HEALTH digital platform you will be provided with a list of health services providers based on the selection criteria that you provide and on provider availability. The information we make available about any particular health services provider is supplied to us by that provider, and SANED HEALTH makes no warranty as to its accuracy. Users of the SANED HEALTH digital platform are ultimately responsible for choosing which health services provider to communicate with.

 

 YOUR COMMUNICATIONS 

You are responsible for your own communications using SANED HEALTH. You may not:

  1. communicate material that is copyrighted, without the permission of the copyright owner.

  2. communicate material that reveals trade secrets, unless you have permission of the owner.

  3. communicate material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.

  4. communicate material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to any person or entity.

  5. communicate a sexually explicit image.

  6. communicate chain letters or pyramid schemes.

  7. impersonate another person; or

  8. violate the Children's Online Privacy Protection Act.

The Websites and Platforms are provided on an "as is" and "as available" basis and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, SANED HEALTH disclaims all representations, warranties, and conditions, express or implied, including, but not limited to, implied condition or warranties of merchantability and fitness for a particular purpose. SANED HEALTH does not warrant that the Websites and Platforms will be uninterrupted or error-free, that defects will be corrected or that the Websites and Platforms or the server that makes it available are free of viruses or other harmful components.

SANED HEALTH makes no guarantees and disclaims any implied warranty or representation about its accuracy, relevance, timeliness, completeness, or appropriateness of any content posted on the Website and Platforms for a particular purpose.  SANED HEALTH assumes no liability arising from or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Websites and/or Platforms.

A virtual consultation is an alternative method of providing care to patients that efficiently respond to routine, non-complex medical problems.

The virtual consultations and care provided, in no shape or form is a substitute for actual medical intervention whose nature might be complex and should not be utilized for complex, non-routine or emergency medical care. In the event of such a situation, the patient must immediately consult the nearest available medical care provider.

Saned Health App Requires location permission to enable Bluetooth Devices to be connected to the application even when the app is in use. No location data is collected or shared  with any third party. Saned Health does not track your location neither saves location data.

 

ACCOUNT 

Your account is associated with your mobile number and is verified via an OTP sent to your mobile device; this will allow you to access the SANED HEALTH digital platform. You are solely responsible for safeguarding your mobile device and are prohibited from making available your mobile device to any third party. You agree to notify SANED HEALTH Customer Support or Admin at info@sanedhealth.com  immediately of any unauthorized use of your mobile device or of any need to reset or lock down the account. 

Privacy Policy 

We view protection of your privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. We store and process your information on our servers that are protected by physical as well as technological security devices. We use third parties to verify and certify our privacy principles. If you object to your information being transferred or used in any way, please forward your request to the Company or deem not to use the website.

We do not sell or rent your information to any third parties without your explicit consent.  

Registration includes the information (your information) that you need to provide us to deal with us and also to contact you. We also collect information about the consultations you make, insurance data and prescription data. You agree that we may use (and update) your information to manage your registration and to control your identity during the use of our online services.

The details provided by you during registration will be protected in accordance with our Privacy Policy. Your information will form part of a record of your dealings with us. If you use online services, you are responsible for maintaining the confidentiality of your account and for restricting access to your phone/computer, and you agree to accept responsibility for all activities that occur under your account.  

The online services assume no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your account. Any suspicious activities on your account shall be notified by contacting us immediately through contacting us. Click on “Contact Us” within the mobile app.

  Electronic Communication  

As you use online services and communicate with us electronically, you also consent to receive communications from us electronically, by means of emails, newsletter or by posting notices such as disclosures on the website/mobile app. You agree that any communication that we provide to you electronically satisfy any legal requirement, as in writing.

We may monitor, record, store and use any telephone, email or other electronic communications with your information for training purposes, to check instructions given to us and to improve the quality of our patient services. 

 

  TERMINATION 

SANED HEALTH may terminate any user's right to use this app at any time. SANED HEALTH reserves the right to block, delete or stop the uploading of materials and communications that it in its sole discretion finds unacceptable for any reason. If your right to use this app ends, you shall make no further use of this app or any information obtained from this app. If you find that you have been terminated, you may contact SANED HEALTH Customer Support at info@sanedhealth.com for further information.

  LINKING TO OTHER APPS/SITES 

From time to time we will provide links to other apps/websites, not owned, or controlled by SANED HEALTH. We do this because we think this information might be of interest or use to you or where, as a user, we can provide you with value-added services. While we do our best to ensure your privacy, we cannot be responsible for the privacy practices of other apps/sites. A link to a non-SANED HEALTH app/website does not constitute or imply endorsement by SANED HEALTH.

Additionally, we cannot guarantee the quality or accuracy of information presented on non- SANED HEALTH apps/websites. We encourage you to review the privacy practices of any app/website you visit.

 

 APPROPRIATENESS OF CONTENT 

This app is not intended to attract children under the age of 18. Children under 18 must be enrolled on the app under their parent or guardian’s account as a dependent. Parents or guardians are solely responsible for being present with their minors when using the SANED HEALTH app. 

 NO LIABILITY FOR COMPUTERS AND NETWORKS USED TO ACCESS YOUR ACCOUNT 

We are only responsible for the security of the computer systems we own and operate. SANED HEALTH shall have no liability for information about you stored or recorded by any computer or mobile device or any network, whether public or private, that you may use to access SANED HEALTH.

  ACCEPTABLE USE 

You agree not to access or use the SANED HEALTH digital platform for an unlawful or illegitimate purpose. You shall not attempt to disrupt the operation of the services or the SANED HEALTH system. You shall not attempt to gain unauthorized access to any user accounts or computer systems or networks.

  OPERATION AND RECORD RETENTION 

SANED HEALTH reserves complete and sole discretion with respect to the operation of SANED HEALTH. SANED HEALTH may withdraw, suspend or discontinue any functionality or feature of the services. SANED HEALTH is responsible for maintaining data arising from use of the services, but does not warrant the accuracy or completeness of the data stored. SANED HEALTH reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the SANED HEALTH system pursuant to its internal record retention and/or destruction policies.

 

  INTELLECTUAL PROPERTY 

All of the content available on or through SANED HEALTH app/website is the property of SANED HEALTH or their licensors, and is protected by copyright, trademark, patent, trade secret and other intellectual property laws. We give you permission to display, download, store and print the content only for your personal, non-commercial use. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received using the SANED HEALTH digital platform to anyone. All software and accompanying documentation made available for download from the SANED HEALTH app/website is the copyrighted work of SANED HEALTH or its licensors. All other brands and names are the property of their respective owners. Nothing contained on the SANED HEALTH app/website should be construed as granting any license or right to use any trademark displayed on this app/site without the express written permission of SANED HEALTH, or any other party that may own the trademark.

Subject to these terms and the SANED HEALTH User Agreement, SANED HEALTH hereby grants you a limited, revocable, non-transferable and non-exclusive license to use the software, network facilities, content and documentation on and in the SANED HEALTH app/website to the extent, and only to the extent, necessary to access and use the SANED HEALTH digital platform for your personal use.

  DIGITAL MILLENIUM COPYRIGHT ACT 

SANED HEALTH respects the intellectual property of others and expects users of our apps/website to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this app/site or through this service, you must provide the following information when providing notice of the claimed infringement to SANED HEALTH

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner and identification of the copyrighted work that is infringed.

  LIABILITY OF SANED HEALTH AND ITS LICENSORS AND SUPPLIERS 

No Liability. SANED HEALTH AND ITS LICENSORS AND SUPPLIERS (INCLUDING, FOR THE PURPOSES OF THIS ENTIRE SECTION, ALL PROVIDERS OF CONTENT FOR THIS APP/WEBSITE) SHALL NOT BE LIABLE TO YOU, UNDER ANY CIRCUMSTANCES OR UNDER ANY THEORY OF LIABILITY OR INDEMNITY, FOR ANY DAMAGES OR PENALTIES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL INDIRECT, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) IN CONNECTION WITH THE USE OR INABILITY TO USE THIS APP/SITE OR THE CONTENT, EVEN IF ANY OF THEM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SANED HEALTH SHALL BE LIABLE TO YOU ONLY TO THE EXTENT OF ACTUAL DAMAGES INCURRED BY YOU. THE REMEDIES STATED FOR YOU IN THESE TERMS AND CONDITIONS ARE EXCLUSIVE AND ARE LIMITED TO THOSE EXPRESSLY PROVIDED FOR IN THESE TERMS AND CONDITIONS.

SANED HEALTH and its licensors and suppliers are not responsible for any claims you may have against any medical professionals, suppliers of products or other persons, institutions or entities identified in whole or in part through this app/website.

No Warranties. THE APP/SITE, SERVICES, CONTENT AND INFORMATION ARE PROVIDED "AS IS." SANED HEALTH, ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD PARTIES RIGHTS OR FITNESS FOR A PARTICULAR PURPOSE.

SANED HEALTH, ITS LICENSORS AND SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES THAT THE INFORMATION IN, OR LINKS OR SEARCHES CONDUCTED THROUGH THIS APP/SITE IS COMPLETE, EXHAUSTIVE, RELIABLE, CURRENT OR ACCURATE. NO CLAIMS OR ENDORSEMENTS ARE MADE FOR ANY DRUG, HERB, SUPPLEMENT, COMPOUND, THERAPY, OR TREATMENT.

   INDEMNIFICATION 

Without limiting the generality or effect of other provisions of this Agreement, as a condition of use, You agree to indemnify and hold harmless SANED HEALTH and its licensors and suppliers and their parents, subsidiaries, affiliates, suppliers and their officers, directors, affiliates, subcontractors, agents and employees (collectively, "Indemnified Parties" and each, individually, an "Indemnified Party") against all costs, expenses, liabilities and damages (including attorney's fees) incurred by any Indemnified Party in connection with any third party claims arising out of: (i) your use of the SANED HEALTH and/or your receipt of services; (ii) your failure to comply with any applicable laws and regulations; and (iii) your breach of any of your obligations set forth here. You shall not settle any such claim without the written consent of the applicable Indemnified Party.

  CHANGES TO THIS NOTICE 

SANED HEALTH may revise, modify or amend the information contained on this page at any time without notice. Any such revision, modification or amendment shall be effective immediately upon either posting it to this app/website or otherwise notifying you.

To the extent that the law and/or any applicable regulation allows for the provision of notice electronically, use of this app and the SANED HEALTH digital platform constitutes agreement by the user to receive all such notices electronically, including but not limited to notices required by state or federal privacy laws, and all financial information pertinent to, or required in connection with the operation of SANED HEALTH.

AS A USER YOU UNDERSTAND THAT SANED HEALTH IS ONLY A DIGITAL PLATFORM OF COMMUNICATION BETWEEN DOCTORS/CONSULTANTS AND MEMBERS, HENCE NOT LIABLE FOR ANY INDEPENDENT PROFESSIONAL ADVISE. ONLY DOCTORS/CONSULTANTS ARE LIABLE FOR THEIR ADVICE CONSULTANCY. BY USING THIS APP, YOU PROVIDE CONSENT AND AGREES NOT TO TAKE ANY LEGAL ACTION AGAINST SANED HEALTH, ITS DIRECTORS, PARTNERS OR STAFF FOR ANYTHING. THIS IS YOUR RESPONSIBILITY THAT YOU UNDERSTAND AND RE-CHECK WHERE YOU BELIEVE THAT MEDICAL ADVICE OR CONSULTANCY MAY NOT BE CORRECT.
